The Libertarian Party of Kentucky, along with the Kentucky Constitution Party, has filed suit in federal court against the state of Kentucky over ballot access.
Kentucky law mandates that the only way a political party can become recognized is by polling 2% in the most recent Presidential election. Kentucky is the only state in which it is impossible for a party to ever be ballot-qualified until it polls a particular share of the vote for President.
Only four parties have met the 2% Presidential vote test in the last 100 years, with the Reform Party the last to do so, in 1996.
A candidate running for President, or any other statewide office in Kentucky, must collect at least 5,000 signatures.
